Delivery & Installation Policy
1. Introduction
This Delivery & Installation Policy explains the procedures, responsibilities and requirements associated with the delivery, installation, commissioning and support of products and services supplied by Indoor Entertainment, S.L. trading as Black Box Golf (“Black Box Golf”).
By placing an order, accepting a quotation, paying a deposit or engaging our services, customers agree to the terms contained within this policy.
2. Delivery Areas
Black Box Golf supplies products and services throughout:
- Spain
- Portugal
- France
- United Kingdom
- Selected European territories
Delivery and installation availability may vary depending on location, project complexity and scheduling requirements.
3. Estimated Delivery and Installation Dates
Any delivery dates, lead times, project schedules or installation dates provided by Black Box Golf are estimates only.
Whilst we make reasonable efforts to meet projected schedules, we cannot guarantee delivery or installation dates.
Delays may occur due to:
- Manufacturer lead times
- Product availability
- Material shortages
- Freight and logistics delays
- Customs procedures
- Weather conditions
- Customer-requested changes
- Third-party contractor delays
- Circumstances beyond our reasonable control
Black Box Golf shall not be liable for losses, expenses, business interruption or consequential damages resulting from delays outside our reasonable control.
4. Customer Delivery Responsibilities
Customers are responsible for ensuring:
- Accurate delivery information is provided
- Delivery access is suitable
- Parking is available where reasonably required
- Delivery routes are clear and accessible
- Appropriate personnel are available to receive deliveries where necessary
Additional charges may apply where deliveries fail due to incorrect information, lack of access or customer absence.
5. Storage of Goods Prior to Installation
Where products are delivered before installation, customers are responsible for:
- Receiving deliveries
- Inspecting deliveries
- Storing products safely
- Protecting products from damage, theft, moisture and environmental conditions
Black Box Golf accepts no responsibility for loss, theft, deterioration or damage occurring after delivery and before installation.
6. Inspection of Goods
Customers should inspect all goods as soon as reasonably practicable following delivery.
Any shortages, visible damage or discrepancies should be reported to Black Box Golf promptly and before installation commences wherever possible.
Customers should retain all packaging materials until any delivery concerns have been investigated and resolved.
7. Delivery Access and Unloading
Certain products supplied by Black Box Golf may be large, heavy or difficult to manoeuvre.
Customers are responsible for ensuring:
- Adequate access routes are available
- Delivery routes are free from obstruction
- Any access restrictions are communicated in advance
- Suitable assistance is available where required
Where additional labour, specialist lifting equipment or multiple delivery attempts are required, additional charges may apply.
8. Site Readiness Requirements
The customer is responsible for ensuring that the installation location is fully prepared prior to the agreed installation date.
Unless otherwise agreed in writing, site readiness includes:
- Completion of construction works
- Completion of decorating works
- Completion of flooring installations
- Completion of electrical works
- Completion of network and internet services
- Completion of lighting installations
- Completion of HVAC and ventilation works where required
- Safe working conditions
- Unrestricted access to the installation area
Installation teams may be unable to proceed where the site is not ready.
9. Customer Measurements and Room Information
Black Box Golf frequently prepares quotations, layouts, visualisations and technical recommendations based upon information supplied by customers.
Customers are responsible for ensuring that all measurements, dimensions, plans and site information supplied to Black Box Golf are accurate.
This includes:
- Ceiling heights
- Room dimensions
- Structural information
- Door openings
- Access routes
- Architectural drawings
- Site photographs
Where inaccurate information results in design changes, installation delays, equipment incompatibility, additional labour or project modifications, Black Box Golf reserves the right to apply additional charges.
Black Box Golf shall not be responsible for costs arising from inaccurate information provided by customers or third parties acting on their behalf.
10. Electrical Requirements
Customers are responsible for ensuring that all electrical works required for the project have been completed by suitably qualified professionals.
Black Box Golf shall not be responsible for delays, failures, equipment issues or additional costs resulting from inadequate electrical infrastructure.
11. Internet and Network Requirements
Many golf simulator systems require reliable internet connectivity and network infrastructure.
Customers remain responsible for providing suitable internet and network services where required.
Black Box Golf cannot guarantee performance where customer internet services are inadequate or unavailable.
12. Access Requirements
Customers must ensure safe and suitable access for delivery and installation personnel.
This includes:
- Door widths
- Stair access
- Lift access where applicable
- Vehicle access
- Safe unloading locations
- Clear working areas
Where specialist lifting equipment, additional labour or alternative access arrangements are required, additional charges may apply.
13. Customer-Supplied Materials
Where customers choose to provide materials, fixtures, fittings, fabrics or other products for incorporation into a project, Black Box Golf cannot guarantee:
- Suitability
- Compatibility
- Durability
- Performance
- Appearance
- Fitness for purpose
- Compliance with local regulations
Black Box Golf accepts no responsibility for defects, failures or performance issues arising from customer-supplied materials.
Any additional labour or remedial works resulting from customer-supplied materials may be chargeable.
14. Customer-Supplied Fabrics, Curtains and Finishes
Where customers provide fabrics, curtains, decorative finishes, wall coverings or similar materials, Black Box Golf shall not be responsible for:
- Material suitability
- Light control performance
- Acoustic performance
- Fire ratings
- Durability
- Installation compatibility
- Visual appearance after installation
Responsibility for selecting and approving such materials remains solely with the customer.
15. Third-Party Contractors
Black Box Golf frequently works alongside contractors appointed directly by customers, including:
- Builders
- Architects
- Interior designers
- Electricians
- Network installers
- Project managers
- Structural engineers
Black Box Golf is not responsible for the performance, workmanship, scheduling, delays, errors or omissions of third-party contractors.
Any delay, rework or additional costs arising from third-party contractor activities may result in additional charges.
16. Installation Delays
Where installation cannot proceed due to:
- Incomplete site preparation
- Customer delays
- Contractor delays
- Builder delays
- Architect delays
- Electrical delays
- Internet installation delays
- Restricted access
- Health and safety concerns
Black Box Golf reserves the right to:
- Reschedule installation works
- Charge additional labour costs
- Charge additional travel costs
- Charge accommodation expenses
- Charge return visit fees
- Apply standard daily installation rates
17. Working Hours
Unless otherwise agreed in writing, installation activities are normally undertaken between 08:00 and 18:00 local time.
Work required outside standard working hours may be subject to additional charges.
18. Customer Representative
Customers shall appoint a suitably authorised representative who is available during the installation period.
The appointed representative must be able to:
- Grant access
- Make project decisions
- Approve minor installation adjustments
- Coordinate with contractors where necessary
Delays caused by unavailable decision-makers may result in additional costs.
19. Project Changes
Changes requested after quotation approval, order confirmation or project commencement may result in:
- Revised pricing
- Revised lead times
- Additional design fees
- Additional installation fees
- Additional material costs
Black Box Golf reserves the right to re-quote projects where substantial changes occur.
20. Environmental Conditions
Customers are responsible for maintaining suitable environmental conditions within the installation area.
This includes appropriate:
- Temperature
- Humidity
- Ventilation
- Weather protection
Black Box Golf shall not be responsible for damage, deterioration or performance issues caused by unsuitable environmental conditions.
21. Existing Building Conditions
Black Box Golf shall not be responsible for hidden defects, structural issues, damp, water ingress, asbestos, concealed services, inadequate construction or other pre-existing building conditions discovered before, during or after installation.
Any remedial works required as a result of such conditions shall remain the responsibility of the customer.
22. Software and Third-Party Manufacturers
Golf simulator systems frequently rely upon third-party hardware, software, subscriptions and cloud services.
Black Box Golf shall not be responsible for:
- Software updates
- Software bugs
- Subscription changes
- Feature removals
- Licensing changes
- Product discontinuations
implemented by manufacturers or software providers.
23. Performance Expectations
Black Box Golf does not guarantee:
- Improvements in golfing ability
- Handicap reduction
- Sporting performance
- Business profitability
- Commercial success
- Revenue generation
Results achieved through use of simulator technology will vary between users and environments.
24. Pre-Installation Confirmation
Black Box Golf reserves the right to request written confirmation that all site readiness requirements have been completed before installation teams travel to site.
Failure to provide accurate confirmation may result in delays, rescheduling and additional charges.
25. Commissioning and Handover
Upon completion of installation, Black Box Golf will undertake reasonable commissioning and testing procedures.
Customers will be provided with an opportunity to inspect the installation and identify any genuine defects or snagging items.
26. Snagging Items
Minor defects, adjustments, software updates, commissioning activities, cosmetic touch-ups or snagging items shall not prevent practical completion of the project and shall not constitute grounds for withholding payment.
Such items will be addressed within a reasonable period following completion where appropriate.
27. Customer Acceptance
The following shall constitute acceptance of the installation:
- Signed completion documentation
- Use of the installed equipment
- Written confirmation of completion
- Occupation or use of the facility
Following acceptance, any defects will be addressed in accordance with applicable warranty provisions.
28. Delayed Customer Acceptance
Where installation has been completed but customer acceptance is delayed for reasons outside Black Box Golf’s control, the project shall be deemed substantially complete for invoicing purposes.
Outstanding balances shall remain payable in accordance with agreed payment terms.
29. Waste Disposal
Unless otherwise agreed in writing, Black Box Golf is not responsible for the disposal of packaging materials, pallets, construction waste or redundant customer equipment.
Packaging materials and installation waste may be consolidated into a customer-designated area for disposal.
30. Health and Safety
Black Box Golf reserves the right to suspend or postpone delivery and installation activities where health and safety concerns are identified.
Any resulting delays or costs may be chargeable.
31. Force Majeure
Black Box Golf shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Extreme weather
- Industrial disputes
- Transportation disruption
- Supplier failures
- Government restrictions
- Utility failures
- Public health emergencies
